My wife got a job offer on contract basis for 3 months. I am on h1 and she is on h4 so far. I am planning to stay on h1 itself. If my wife accepts this job using EAD, Does my status also changes? Is it okay if she dont find a job after this contract expires, what status she will be in during that time, h4 or EAD?
Please advice, Thanks a lot ....

Hi, My Lawyer says that texas SWA gave him a figure of $ 105,000 annual salary as a prevailing wage for 5 years experience java,j2ee guy.

$105,000 salary for 5 years exp with J2EE/Java sounds rights to me. People with 2/3 year experience are making around 80-85k.

You can file uptill Sep30 2010, or when the quoto gets over, whatever happens first.
And as far as your start date is concerned, if your H1B is from the 2009-2010 quota and you've applied for it after oct 2009, it can start anytime after Oct2009 till Sep2010 ( the date your H1B gets approved), please get this confirmed though.

are there any chances of any nurse or schedule A relief bill this year or even in 2010?.......is it going to be an eternal wait for us?.....will there ever be any bill/law to give us any separate gc numbers even though the shortage continues to grow??

Arrange the two things how you like. Next go to Edit and click Select All. Then go to Arrange and click Group. Last add your animation. I hope that helps you. :)

No you do not need an airport transit visa if you are travelling via Germany by Lufthansa using ur AP. Until and unless you do not change terminals it should be fine and all lufthansa flight arrive/depart from same terminals.
I just returned yesterday using my AP and I traveled via Munich.
You will be asked for your AP at immigration in India as well as while transiting in Germany..

Use the AR 11 online process to change address do it seperately for yourself and your wife. When you have finished submitting new address the system will prompt you asking if you have any pending applications with USCIS. At that time enter the receipt numbers of all pending applications. This will do the needful. You can track the success by checking the case status in few days you can see a soft LUD on your pending applications. Also in few weeks you will receive a letter from USCIS at your new address that tells that they have updated the address. Some folks even call USCIS and verify the address change.

Remember, you are signing each and every form. Which means you are certifying the following: "I certify, under penalty of perjury under the laws of the United States of America, that this application and the evidence submitted with it is all true and correct."
So when a form asks for your address, it HAS to be YOUR address. Providing any other address would be illegal. Tell your employer he/she cannot force you to commit perjury.

Recently my employer written a mail saying that he is closing the company and said to look for new employer.Previously i am working through a middle layer.When i found new employer he directly approached main vendor regarding contract.Now i am working without middle layer.Mean while middle layer hold my 45 days pay .The middle layer is not willing to pay.It is almost 8 months.I worked more than 20 months through middle layer.Can i get my money back?The middle man Threatening saying there is contract which you cannot go and it is breach.Can you please advise.

I would like to get your opinion on current situation.
Education: MS(Ind Engg), 5+ yrs exp.
I have priority date of Oct -2007(applied for labor under EB3). Got approved I-140 in Feb 2008( EB3 category). I got promoted to next level so requested to apply for labor once again in EB2 category in Feb 2009 and got approved labor in Feb 2010.
Is there a provision to amend labor and include previously approved I-140? Or Do I have to apply I-140 once again? and my priority date would be Feb 2009?

My wife has FP appointment scheduled for 12/29/07, She is in india now. I have returned from india today only(12/28) and saw the FP appointment. Can i reschedule FP one day before the appointment date? If i send the reschedule request today will USCIS accept it? since there is only one day left. Please advice me.

On 11/27 last month you said that you had received your FP appointment notice and you want to reschedule it . Did you not do it at that time ? Is this the second time you want to reschedule.
The procedure is the same as explained in your first post and yes you can reschedule it one day before it is due ( but I would strongly advise against it if this is the second time you want to reschedule ).
But I guess since your wife is in India you have no choice. Consult your lawyer also in this case so as to keep him in the loop and get his advise also.

Yep lawyer himself told thats not ideal i checked with another attorney he said that should be fine and INS understands it. Lets see . thanks for your reply though.
