My situation is that Lawyer says I-485 appl. was hand delivered to INS at Nebraska on July 2nd morn. They had sent about 300 appls. July 2nd that way to avoid the change of dates fiasco etc.
Now, his office says that INS has not given any receipt for the delivery or acceptance of the hand delivered packages and there is no way to get a receipt etc. until checks are cleared. Since there is no tracking # etc. from fedex we are in the dark about the acceptance situation. According to him none of the packets have been returned either.
Is there anyone else in a similar situation?

The immediate solution is full accountability of all pending applicants for employment based immigrant visas both at USCIS and DOS. Without accurate data, it is difficult to hold the agencies accountable for their actions or inactions.
Another solution is to �recapture� lost visas. Between 1994 and 2006, USCIS underutilized the visa numbers by approving less than the 140,000 employment based applications each year even though USCIS had more than enough applications pending. Due to the statutory calculation method (explained more fully by USCIS and DOS on their websites), USCIS�s failure to timely process a sufficient number of applications resulted in the loss of approximately 349,000 visa numbers that could not be used in future years since the law prevents usage in future years. In 2000, Congress authorized the use of 130,000 these �lost� visa numbers by what has come to be known as the �visa recapture� method. However, approximately 219,000 numbers have not been �recaptured�. The current worldwide pending cases in all employment based categories is approximately 340,000 applicants. A one‐time recapture of the 219,000 unused visa numbers could go a long way to eliminating this backlog and bringing much needed relief to many applicants who currently face the prospect of becoming residents of the United States after they retire.

Not sure if I posted this on right forum....
I'm at 485/EAD stage. not on H1b anymore. I recently badly sprained and fractured my ankle/foot. Am considering taking a leave for maybe two weeks from work.
Question: does going on short term disability and getting benefits from the state have any adverse effect on the immigration process?

If you file the extension before expiry of the current I-94, you will be OK. It can be approved even after the expiry. She will be considered to be legally present without gap, if extension is granted.

My lawyer received all the receipts for our AOS, EAS and AP applications and today I got COPIES in mail from her.
Wasn't she supposed to send me the originals and keep the copies? After all, it's my application.
I want to call her but I'm not sure what the general practice is. Did you guys get copies or the original receipts from your lawyers?

I applied my labor as Software Engineer and BEC approved it with a code of Mechanical Engineer. I got it changed, but took me a year though. They kept my change request until the end when they were ready to shutdown BEC.
I probably go ahead and use what in the approved labor certificate. by the way how do I find exact job-code that I used in the I-140.

My Company applied PERM in Sept'07 at Chicago. Till now company hasn't heard back yet and now employer is planning to file one more PERM appl. through different Lawyer. Can we file one more application without hearing/know the first case status?

you should not file another perm appl unless it is different job duties. you lawyer should call dol. it takes min of 8 months for perm filed in 07.

Friends:
Two weeks ago I received an RFE for my E-Filed I-131 Advance Parole.
They requested two passport-style Photos but didn't mention where to send the RFE response.
However, on the top right-corner (next to the US Dept. Homeland security Logo) on the RFE page, there is an address (P.O Box 852381 Mesquite, Texas 75185-2381).
Underneath of the Director signature it has Officer # 159.
I'm really confused
1. Which address to send the RFE response?
2. Attention to what??? (Should I put Attn: to this officer # 159)
Please guide me ASAP...

Congress is slated to approve a three-week spending measure over the next few days that would extend a March 18 deadline to keep the government�s lights on until April 8. In the meantime, lawmakers hope they can agree on a longer-term continuing resolution through September when this fiscal year ends."

Wait time for spouse to get a green card as a derivative from you would be apporximately 5 years since you already have your green card now. the best option is to wait for to get your US citizenship and them apply for your spouse and in that case the max. wait time os only 3-6 months. Will they send an RFE immediately even after the I-485 has been pending for more that 180 days?
depends on the officer. A lot of officers do not know the AC21 law. As soon as they see 140 being revoked, they blindly send denial notices for 485 and you have to correct this through MTR.
After a 140 revocation by ex employer, it takes a few weeks for USCIS to act.

I switched my job in first week of October this year and My new employer filed the H1B transfer petition on Sep 26 (USCIS Receipt date). It has been almost two months and USCIS online status still shows case received and pending, while California State Center processing dates shown Oct 15 which is 20 days after Sep 26.
Is there anyone who has expereineced the same and want to share?
I am bit concerned because my employer has started the GC process and will be ready to submit the PERM application in few weeks.

I received an RFE for employment verification. My ETA 750 list Occ Code as 15-1061 (Title - database Administrators). But in my new job I am working as .Net developer where I work with front end and back end development of their website. I work in C#, ASP.NET, java, Flash.
My attorney asked me to find tasks matching with O*net description of Occ Code 15-1061 . None of them directly relate, but some or part relates. Am I in trouble because I no longer work in database development.
In my new job I am working on H1-B

Hi,
My friend and his family got their GC's approved last week. They also have Canadian GC. My friend is the primary applicant and she is currently in US, but her husband is in India. He did not apply for an advance parole and was planning to re-enter the country using his Canadian GC. Now that his US GC is approved, will there be any issue at the port of entry?
