If H4 uses EAD for work with 485 pending, and if the underlying I-140 gets rejected, will this make H4 holder be out of status? what are the options for H4 holder.

The following news items suggest there would be a serious attempt to pass CIR early in 2009 in both the houses of congress. That makes DC rally really more important as we just cannot afford to let even a single Durbin/Grassley provision to slip into CIR.

Hello
Well need some help. I moved from H1-B to F1 visa to do masters. Now I want to quit F1 in middle and go back to doing H1-B and continue masters part time.
I know there are still slots open for H1-B for 2010. Please correct me if I am wrong.
Now I can do summer internship untill August 26, the question is, how can I work for the employer for the month of September? since H1B starts on Oct 1st. I can do CPT full time but, then again I heard you can not quit CPT in middle of the semester.
Any suggestions will be greatly appreciated.

It is better to wait to switch after your I-140 approval ....
If you switch before, your employer could cancel the application or might not answer RFE if one is issued ...
If you are sure that employer will be very cooperative, then you can easily shift now ...

Congrats to IV core team on pulling something very improbable; filing I-485 till Aug 17th honoring the July visa bulletin.
Any idea what are the options for Employment-based CP? I already applied for CP and am waiting for Packet 3. Packet 3 itself takes 6-8 weeks for processing. I tried to find info when visa number is alloted when u choose CP for greencard. I am getting conflicting information.
Can I file I-485; can I switch to 485 from CP. How long does the switch take. Thanks for ur inputs.

Just asking out of curiosity because when an illegal alien lives and possibly runs from cops from place to place for a period of time then they are qualifed for a green card and eventually citizenship.
Why would they become nice to them after a certain period of time? It is illegal.

Hi Gurus,
My PD is Aug 2005 (EB2 India). Last year, during September - October my case was picked up and I think it is processed, but because of lack of visa numbers, the case was not approved. (I wrote a senator letter, he got back saying that the file is processed and waiting for visa numbers)
Now, I got 2 offers. First one is a fulltime position and 2nd one is a contract with a primary vendor (directly working on W2 using EAD). I haven't decided which one to join.
What are the options, I have? Do I need to file AC21? Since my file is already processed and waiting for the PD to become current, am I OK, even if I don�t apply for AC21? If I file AC21 and if the job descriptions are not matching or because of any other issues, if there is an RFE, I will be having some issues.
Gurus please let me know your thoughts.

Hey vibedesign,
Create and animate the text that you wish to have "wireframed" in Swift 3D. When exporting the SWF, make sure you select the No Fill option. Consequently, make sure you select the Outline option with Entire Mesh or another setting selected! That should export your animation without the fill but with the outlines instead. That will look like a wireframe text effect!

We should not look ungrateful. People will appreciate this community even more if we show gratitude too. The press we got for our non violence movement along the lines of Mahatma Gandhi, speaks of our integrity and our culture.
We have a strong cultural background, with Mahatma Gandhi as our visionary and ideal. We follow his principles and I am sure if he had been here today, he would have had the same drive to thank the government for revoking their decision and restoring faith in the immigrant community?

I'm new at this forum and am hoping someone would be able to shed some light on my dilemma. My labor certification is currently under supervised recruitment. I checked the America's Job Bank website and found my ad, but the job description in it contained only the part according to O*Net occupation description. The form ETA-750 had some additional job requirements posted by the employer, which were omitted in the AJB ad. I'm afraid with the current ad at AJB they'll get tons of applications.
Can someone advice what shall I do?

Hi,
I came US through H4.Currently on H1 since Oct 08. As Economy is bad,my employer couldnot place me in a project.So my employer is asking to convert from H1 to H4(by applying i-539) and once i get project can move back from H4 to H1, which will not come under seperate Quota as my H1 is already approved once.
Can i know is this safe to move from H1 to H4 and then back from H4 to H1 once i get project.Will there be any issues in converting H4 to H1.What are the chances of getting H1 back.
Please advice.Any suggestions is really appreciated.
