Folks,
My wife got terminated on Feb 13th, she received her last pay stub on Feb 20th...We haven't applied for a COS till date...Is she now out of Status..??? She was waiting on her last paystub before she can apply for a COS and she received around 24th of last month and now we are all ready to send our documentation for COS to USCIS. During this span of 2 weeks is she considered staying illegal here..??
I was reading somewhere if USCIS receives her COS after her employer h1b revocation, she might be denied her COS...Is this true...??? Please Advise.
I was also reading somewhere about e-filing for COS, is e-filing available for H1 to H4 COS..??

There's a phrase in American pop culture - "jump the shark" that seems appropriate about now. I guess in the facing rapidly declining ratings, Mr. Dobbs is resorting to even more extreme rhetoric and has now joined the "birthers" desperately peddling one of the sillier conspiracy theories out there. While it showed weak moral stamina, I could at least understand the economic reasoning behind CNN keeping Dobbs on the air when his show was producing healthy ratings. But even that justification for leaving him in prime time has evaporated. It's time to pull the plug. Hat tip to George C....

I would really appreciate it, if someone could give me some advice.
Here is my situation, in January 2005, I married my girlfriend, who I had dated for little over a year. She is a US born citizen, so we decided to file for my permanent residency upon marriage. Upon receipt of my Green Card in Jan 2008, I filed for naturalization. Our relationship started heading south last year. We tried counseling and it didn't work out. We finally decided to part our ways amicably in Sep, 2009.
I am 34 years old and for reasons unknown to me, I am showing signs of age. I have been also getting some pressure from my family in India to remarry. Though I do not have any plans to marry immediately, I wasn't sure if my getting naturalized in February 2009 would have any impact on marrying someone from India sometime next year?
Please let me know, if there are any cooling off period required?

I am masters student graduating in June 2011. I got an offer from a big company and it already started h1b premium processing(applied on Mar 31). Now, I received an offer from my dream company and I didn't mention about h1-b processing and want to work for this company. I have few questions and need your suggestions.
1. Reject the first company offer. Not sure if I have to pay, because they applied for H1-B premium processing. How much I have to pay in this case? Can I continue working on OPT in this case?
2. Inform the second company about the first company h1-b processing. What can second company do, if H1-B is already processed? What can second company do, if H1-B is not processed?
Please suggest if there are better ways to handle the situation.
-- How long does it take to get H1-B visa under premium processing, if applied in 65000 pool?

Hello folks. I hope someone can help me out on this issue. I applied for my wife's EAD back in July 2007. The EAD was processed in two weeks and we received the card. However, my wife's middle initial was incorrect and we sent it back to USCIS with an explaination concerning the mistake. USCIS stated that it would take anywhere from 2 months to 6 months to process the correction. Last week I received a letter from USICS stating that I need to submit a completed I-90 form. A I-90 form is used to replace a green card. We just applied for our adjustment of status in 6/2007 and are not permanent residents at this point. Getting the EAD has become a nightmare for us. Do I try and write a letter back to USCIS stating that they are asking for the wrong form. I tried to call them but they said to respond to the letter sent. I'm stuck between a rock and a hard place. Any help/advice would be appreciated.

Latest SR got me a letter yesterday from local office stating "need to perform additional review...blah...blah..." On other hand I got another letetr last week from CAO-USCIS as Washington signed by a supervisor staing that my case is stuck coz "I never attended NSEER interview in 2003 and as a ocurtesy she has arranged for my interview at ICE office in Boston". I was amused coz my passport is littered with NSEER stamps and I had the same RFE during one of EAD renewal and after the reply they promptly approved the EAD!
It speaks volume about USCIS's efficiency. Anyway, I'm saving all these letters and will file WOM at the beginning of next year.

You should pay taxes in PA.
In case your employer is running the payroll from MI, then file MI taxes as Non resident and PA as resident. You will get credit for paying non resident taxes in MI on PA's state tax form.
Don't pay resident taxes in the state where you are not staying. I got this info from a HR block tax consultant..

I am filling out an LCA online for an employer who is hiring someone as an H-1B transfer. I am using iCERT and had a question as I go through the process:
Part E. Attorney of Agent Information
16. Law firm/Business FEIN:
This sections asks me for my law firm tax ID number. However, I am a solo practitioner so do not have a TIN or EIN - I use my SSN for taxes etc.
If I leave this part blank, or put N/A will this make them deny my LCA? I called their help desk, but am waiting (who knows how long) for them to respond.

Hi,
I am GC holder & right now I am living out side USA with my husbad whom I am married for more than 8 yrs. I have 2 kids, they are US citizen. I visit my parents (US Citizen) every year to US for couple of months & come back. In past my husband tried for US visitor visa few times but he was denied. Is there any way I can apply for my husnad a non immigrant VISA from US for a visit? As we would not like to migrate to US but just to visit there. Is there any way or I have to apply for him immigrant visa only & wait for 5-7 yrs.?
Please guide.

We filed our 485s during the July 2007 fiasco. We moved after an year, so we updated USCIS with our new address by filling AR11 online for all the petitions(485s, 140)
My 485 status is in pending state but by husband's petition has a status of "Notice Returned as Undeliverable". Now it is more than 6 months since that update. Do I have to follow up on it? Any input appreciated. Thanks much in advance.

if you are out of country then why don't open account in ICICI or reliance to do trading .
