    I was selected in H1b lottery last year however my petition was sent back to DSH for revocation.
    I emailed US embassy in Pakistan a couple of time however did not receive any response from them as yet on my case status. So my petition has been returned to DSH but H1b visa has not been rejected yet.
    Now another company is offering me a job. My question is that can I use my previous petition and my new employer can apply for H1b without applying for the H1B lottery again. This will be switching employer before H1b Visa approval OR is it that I will have to wait until some decision is taken on my returned petition to DSH?

    Any suggestions will be much appreciated!!

    Thanks to Googler,

    i called TSC and after about 10 mins or wait, i was directed to a very nice lady. Who basically told me that they are processing April 30 application adn since mine is august RD, I have about 4 more months before they look at my file. So to answer, they do go by RD and not ND. She also tole me that my name check has been cleared. Its a matter of time now.

    I have not seen any updates on my case, since the LUD after FP. I do have a criminal issue, so I anticipate an interview. However, i have forwared all my court docs to them when i applied for 485. some attorneys tell me that interveiw may not even be needed since they have all the court docs. It was for a DWI 8 years ago.

    I have question to all of you. I am the primary filer to I-485. My wife worked on EAD last six months. Now she is out of project. Planning to go india and come back after 6 months.

    Is there any problem, if stays more than 6 months out side country.?
    Some people scaring me.

    I am currently in my 6th year of H1-B. I started working for my current company on H1-b work visa in June 2010. As my 6 year visa period expires in June 2011, I need to apply for a H1-b extension (based on I-140 approval) pretty soon. My employer had paid the $1500 ACWIA fee recently i.e. 8 months ago, when they filed for my H1-b the first time. Next month, when they apply for an extension of my H1, do they have to pay the $1500 ACWIA fee again?

    In I-129 instructions, it specifies that one of the exemptions for paying the ACWIA fee is "second or subsequent extension...". Would my case be considered a subsequent or second extension?

    I would greatly appreciate your response.

    Hi,

    I was an employee with company A till march 2008 and i kept a H1b transfer to
    company B on march 24th 2008. I was working to company B for an year
    on receipt number applied for h1b transfer at USCIS. I got an RFE with
    company B in sept 2008 mean while my I-94 got expired on August 2008.
    Company B answered the RFE and submitted to USCIS on October 2008.
    After waiting for H1B transfer to get approved it got denied on march 10th
    2009.

    Now i wanted to change my status from H1b to F1(CPT). My questions are
    1. If i apply for transfer from H1B to F1 will i be getting New I-94 from
    USCIS?
    2. Should i be going back to india for getting stamped after i change my
    status to F1 ?
    3. Can i be on a student status from the day i receive the receipt notice
    from USCIS for change of status ?

    I would really appreciate your help regarding this issue..

    "The end of 2007 is approaching fast and the new Congress has little to show for it," Bush told reporters in the White House Rose Garden last week.

    Rep. John Boehner of Ohio, the Republican leader in the House of Representatives, was even less generous. "Nothing has been accomplished all year," he said.

    As they excoriate political opponents, Bush and his fellow Republicans in Congress have successfully stopped most major Democratic initiatives this year.

    They have staged an unprecedented number of "filibusters" in the Senate, where Democrats do not have a big enough majority to end debate. The few times that wasn't the case, Bush used his veto pen to kill Democrats' top priorities, like ending the Iraq war, expanding health care to children from low-income families and expanding stem cell research.

    "Sadly, Republicans in Washington are determined to make this a 'no-can-do' Congress," Assistant Senate Majority Leader Richard Durbin, an Illinois Democrat, said in his party's weekly radio address on Saturday.

    With only a week or two remaining in the first half of 110th Congress that convened in January, there's a deflated feeling on Capitol Hill.

    Democrats and Republicans complain not enough has been accomplished. The public seems to agree, with just one in five Americans approving of the job Congress is doing, even worse than the unpopular Bush's ratings.

    The legislative deadlock might get even worse next year, as election campaigns for Congress and the presidency get into full swing.

    Ethan Siegal of the Washington Exchange, a private group that tracks Congress, said of Republicans' opposition tactics: "The template for trying to get into power is to make sure the party in charge doesn't have many legislative successes."

    But even many Republicans think accusations of a "do-nothing" Democratic Congress won't be enough for their party to win back their majority status in the November 2008 elections.

    PROMISES KEPT?

    Democrats quickly fulfilled many of their 2006 campaign promises, raising the minimum wage for the first time in a decade, implementing stalled recommendations of the commission that investigated the September 11 attacks and trying to stop ethics abuses that plagued Congress during years of Republican leadership.

    Republicans blocked many other measures.

    A top domestic priority -- reforming U.S. immigration law -- was buried by conservative Republicans in the House. On foreign affairs, Republicans killed repeated moves to bring combat in Iraq to an end, despite Americans' disenchantment with a war now in its fifth year. Anti-war feeling was a driving factor behind the Democrats' success in last year's elections.

    Popular legislation to expand stem cell research to help cure diseases such as Parkinson's was vetoed by Bush, as was a bill to deliver health care to more children from low-income families.

    More recently, the House passed an energy bill that would improve automobile fuel efficiency for the first time in 32 years but Senate Republicans, heeding a White House veto threat, stopped it.

    And Bush has veto threats on the remaining bills to fund the government through next September.

    He recently told Arkansas business leaders: "You're fixing to see what they call a fiscal showdown in Washington."

    But despite the bluster, Bush and congressional Democrats are at odds over a relatively tiny slice, about $11 billion, of the nearly $3 trillion budget.

    Negotiations between the two finally have begun, but a compromise -- some war funding coupled with some of the additional domestic spending Democrats want -- was showing signs of souring this week, again amid accusations of Republican sabotage. There's plenty of incentive for a deal though as neither side wants government shutdowns to begin if agencies run out of money this month.

    The answer depends on how far you have got in the permanent residence process. If the I-140 is approved and the 485 has been pending for 180 days, you can change employers if the new position is in the "same or similar occupational classification" as the one on the labor cert/I-140.

This year they have selected Cambodian-born Luong Ung who has been the national spokeswoman for Campaign for a Landmine-free World. She's worked on that worthy cause for 13 years. Ms. Ung came to America as a refugee of the "Killing Fields" in her native country and has paid the goodwill back by working on a cause that few would argue is vitally important.     C-SPAN, the exclusive video chronicler of Congress, yesterday took a major step to loosen its copyright hold by announcing that it would no longer object to YouTube or bloggers posting its footage from the Hill or from federal agencies online. The content makes up about half the cable channel's programming.

    Use of the video footage became awkward recently when Republicans accused Pelosi of "pirating" some clips for her new blog, the Gavel. C-SPAN explained that floor footage is shot by government cameras and that Pelosi was on firm ground using it. But C-SPAN did ask her to take down a clip of a committee hearing shot by a C-SPAN camera.

    A C-SPAN spokeswoman said yesterday's action was a nod to the ever-changing technological landscape.

    Guys, Due to all this mess up with dates I decided to file 485/EAD/AP myself and for my wife on 6/29; so filled up everything, attached copies, photos and what not and FedExed all to USICS on June 30 to hit them on 2nd July.

    Now I see that by mistake I have put my SSN on my wife's 765. She has been always on H4, never had SSN.

    1. What can be the consequence of this mistake?
    2. Should I try to pull it back from USICS and submit again (if it's at all possible)

    When Senate Majority Leader Harry Reid picked up his ball and went home after his staged all-night session last week, he saved from possible embarrassment one of the least regular members of his Democratic caucus: Sen. Ben Nelson of Nebraska. Reform Republican Tom Coburn had ready an amendment to the defense authorization bill removing Nelson's earmark funding a Nebraska-based company whose officials include Nelson's son. Such an effort became impossible when Reid pulled the bill.

    That Reid's action had this effect was mere coincidence. He knew that Sen. Carl Levin's amendment to the defense bill mandating a troop withdrawal from Iraq would fall short of the 60 votes needed to cut off debate, and Reid planned from the start to pull the bill after the all-night session, designed to satisfy antiwar zealots, was completed. But Reid is also working behind the scenes with House Speaker Nancy Pelosi to undermine earmark transparency and prevent open debate on spending proposals such as Nelson's.

    These antics fit the continuing decline of the Senate, including an unwritten rules change requiring 60 votes to pass any meaningful bill. When I arrived on Capitol Hill 50 years ago, Majority Leader Lyndon Johnson (like Reid today) had a slim Democratic majority and faced a Republican president, but he was not burdened with the 60-vote rule. While Johnson did use chicanery, Reid resorts to brute force that shatters the Senate's facade of civilized discourse. Reid is plotting to strip anti-earmark transparency from the final version of ethics legislation passed by the Senate and House, with tacit support from Republican senators and the GOP leadership.

    At stake is the fate of Coburn's "Reid amendment," previously passed by the Senate and so called because it would bar earmarks benefiting a senator's family members such as Reid's four lobbyist sons and son-in-law. Nelson's current $7.5 million earmark for software helps 21st Century Systems Inc. (21CSI), which employs the senator's son, Patrick Nelson, as its marketing director. The company gets 80 percent of its funds from federal grants, mostly through earmarks. With nine offices scattered among states represented by appropriators in Congress, the company has in recent years spent $1.1 million to lobby Congress and $160,000 in congressional campaign contributions. "As of April," the Omaha World-Herald reported, "only one piece of [the company's] software has been used -- to help guard a single Marine camp in Iraq -- and it was no longer in use."

    In requesting the 21CSI earmark, Nelson did not disclose his son's employment. "There's no requirement that he disclose that," a Nelson spokesman told this column. "But frankly, in this case, we didn't disclose it because it's so public." An April 24 letter from Levin giving senators instructions on how to request an earmark made no mention of the "Reid amendment" that had been passed by the Senate three months earlier but that required only certification that no senator's spouse would benefit from an earmark. Inclusion of Nelson's son, however, would be required if the ethics bill provision passes.

    When the defense authorization bill came up last week, Coburn prepared amendments to eliminate the Nelson earmark and the most notorious earmark pending in Congress: Democratic Rep. John Murtha's proposed $23 million for the National Drug Intelligence Center in his Pennsylvania district. Reid's plan to satisfy antiwar activists with an all-night debate averted debate, for now, on those two earmarks.

    Reid, the soft-spoken trial lawyer from Searchlight, Nev., has tended to suppress free expression in the World's Greatest Deliberative Body in his tumultuous 6 1/2 months as majority leader. Last week, he cut off an attempt by Sen. Arlen Specter, the veteran moderate Republican, to respond to him with an abruptness that I had not witnessed in a half-century of Senate watching. When Specter finally got the floor, he declared: "Nothing is done here until the majority leader decides to exercise his power to keep the Senate in all night on a meaningless, insulting session. . . . Last night's performance made us the laughingstock of the world." It may get worse if plans to eviscerate ethics legislation are pursued.

    I am on H1 visa and I have a sister with citizenship.
    I am wondering if I can file i-130 (family based immigration) now and file Employment based immigration later?
    Is it OK to file 2 green cards applications? which one will take place then?
